OVERVIEW
Welcome to Pup and Running. The terms “we”, “us”, and “our” refer to Pup and Running. We operate this website and online store, along with all related tools, features, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide these Services to you.

By accessing or using the Services, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use or access the Services.

These Terms outline your rights and responsibilities, including important information around warranties, limitations of liability, returns, exchanges, refunds, and your obligations when using our Services.

SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you confirm you are at least the age of majority in your place of residence, and you consent to any minor dependents using the Services through your devices.

You may be required to provide information such as your name, email address, billing, payment and shipping details. You warrant that all information provided is accurate, current and complete. You are responsible for maintaining the confidentiality of your account and password. You may not transfer or assign your account.

SECTION 2 – OUR PRODUCTS
We make every effort to accurately represent all products on our website. Colours and textures may differ depending on your device settings.

We do not guarantee that products will appear exactly as photographed. All product descriptions and prices are subject to change without notice. We may discontinue products at any time and may limit quantities to any person, location or jurisdiction.

SECTION 3 – ORDERS
Your order is an offer to purchase. Pup and Running may accept or decline your order at our discretion. Orders are not accepted until payment is received and we send an order confirmation.

Please review your order carefully—cancellation requests may not be accommodated once accepted. If we cancel or modify an order, we will attempt to contact you via the details provided at checkout.

Our refunds, returns and exchanges are governed by our Refunds & Exchanges Policy (Section 25 below).

You confirm your order is for personal or household use and not resale or commercial use.

SECTION 4 – PRICES AND BILLING
Prices may change at any time without notice. The price charged is the price shown at the time you place your order. Prices exclude taxes, shipping, handling, duties or customs unless otherwise stated.

You agree to provide accurate billing and account details and to promptly update any changes. You warrant you are authorised to use any payment method you supply.

SECTION 5 – SHIPPING AND DELIVERY
All delivery times are estimates only. We are not responsible for delays caused by carriers, customs, weather or events beyond our control.

Once we transfer products to the carrier, risk of loss passes to you.

SECTION 6 – INTELLECTUAL PROPERTY
All content, branding, product names, images, media, and designs are owned by Pup and Running or our licensors and protected by applicable IP laws. You may use the Services only for personal, non-commercial use.

No reproduction, resale, distribution or modification is permitted without written permission.

All trademarks, including Shopify’s, are the property of their respective owners.

SECTION 7 – OPTIONAL TOOLS
We may offer third-party tools through the Services. These are provided “as is” without warranty. Your use of third-party tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party sites. We are not responsible for their content, policies or actions. Access at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
This store is powered by Shopify. All purchases are made directly with Pup and Running, not Shopify. Shopify is not responsible for any sales, products, losses or disputes that arise. You release Shopify from all claims relating to your transactions with us.

SECTION 10 – PRIVACY POLICY
Personal information is collected in accordance with our Privacy Policy [LINK], and certain information is processed by Shopify in accordance with their Privacy Policy.

By using the Services, you acknowledge these policies and consent to the transfer of personal information as required to fulfil and operate your orders.

SECTION 11 – FEEDBACK
Any feedback, suggestions, reviews or content submitted by you may be used by us for any purpose. You warrant you own the rights to any feedback you submit. We may remove content that violates these Terms.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
We may correct any errors or inaccuracies at any time without notice, including after an order is submitted.

SECTION 13 – PROHIBITED USES
You agree not to misuse the Services. This includes unlawful activity, harassment, spreading malware, collecting data without consent, interfering with security systems, or violating intellectual property laws.

SECTION 14 – TERMINATION
We may suspend or terminate your access to the Services at any time without notice. Certain sections will survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES
The Services and all products are provided “as is” without guarantees of uninterrupted, error-free or accurate operation. Your use of the Services is at your own risk.

SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for any damages arising from your use of the Services or products purchased.

SECTION 17 – INDEMNIFICATION
You agree to indemnify Pup and Running and Shopify from claims arising from your breach of these Terms or misuse of the Services.

SECTION 18 – SEVERABILITY
If any part of these Terms is unenforceable, the remainder will still apply.

SECTION 19 – WAIVER; ENTIRE AGREEMENT
These Terms constitute the entire agreement. Failure to enforce a right does not waive it.

SECTION 20 – ASSIGNMENT
You may not transfer these rights. We may assign them without notice.

SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of New Zealand. You consent to the jurisdiction of NZ courts.

SECTION 22 – HEADINGS
Headings are for convenience only.

SECTION 23 – CHANGES TO TERMS OF SERVICE
We may update these Terms at any time. Continued use of the Services constitutes acceptance.

SECTION 25 – RETURNS & EXCHANGES (Pup and Running Policy)

I take pride in the quality of everything at Pup and Running, and I want you to love what you’ve ordered.

• If your order arrives damaged or incorrect, contact me within 7 days of receiving it so I can arrange a replacement or refund.
• Faulty items must be returned for inspection before a refund or exchange is processed.
• Change of mind returns are not accepted.
• Exchanges are available for non-personalised items if you contact me within 7 days. Items must be unused, unwashed and in original packaging.
• Postage for exchanges is your responsibility.
• Personalised and made-to-order items cannot be returned or exchanged.
• General wear and tear or misuse is not considered a fault.

SECTION 26 – POSTAGE POLICY

• NZ shipping is a flat $8, tracked. Orders ship within 24 hours.
• Personalised/made-to-size items ship within 1–3 days.
• AU shipping is a flat $25, tracked.
• You will receive tracking via email once dispatched.
• International orders may incur customs charges, taxes or duties—these are the customer’s responsibility.

SECTION 27 – SIZING

• Handmade items may vary up to 1–2 cm.
• Made-to-order coats and personalised bandanas cannot be exchanged—please choose carefully.
• Collars and leads may be exchanged if unused and in original condition. Postage costs apply.
• If unsure, contact me via the website or Instagram before purchasing.
